THAT EVENING, DEFENDANTS HAD SOUGHT, BUT WERE DENIED ENTRANCE TO THE ONE SETTE AND ON INFORMATION AND BELIEF WERE LEAVING. AS THEY WERE LEAVING, AVILA OBSERVED DEFENDANTS, CRAIG ANYA AND JOHNSON IN A PHYSICAL ALTERCATlON WITH OUSMAN GOMEZ, WHO ALSO WORKS AS A VALET WITH AVILA. ON INFORMATION AND BELIEF THE ALTERCATION INVOLVED A $10 FEE THAT ANYA WANTED RETURNED BECAUSE HE HAD NOT BEEN ADMITTED TO THE NIGHTCLUB. WHEN AVILA WENT TO BREAK UP THE SKIRMISH BETWEEN HIS COWORKERS AND DEFENDANTS ANYA AND JOHNSON, DEFENDANT ONYEDEHELU RETRIEVED A FIREARM, AND USED IT TO PISTOL WHIP, AND THEN SHOOT PLAINTIFF.
