Said Plaintiffs Original Petition was filed on in cause number CC-21-01271-E, Styled CASSIE BUCHANAN, INDIVIDUALLY AND AS NEXT FRIEND OF MINORS, Plaintiff (s) vs SAMANTHA LOONEY; MICHAEL MONROE, Defendant (s), The nature of plaintiffs demand being as follows: DAMAGES (COLLISION) (ACCOUNT).
STATEMENT
ON OR ABOUT MAY 31, 2019, DEFENDANT LOONEY FAILED TO PAY PROPER ATTENTION TO THE ROADWAY AND VEHICLES IN FRONT OF HER, FAILED TO CONTROL HER SPEED, AND FAILED TO MAINTAIN A SAFE TRAVELING DISTANCE CAUSING THE CRASH WITH PLAINTIFFS' VEHICLE RESULING IN THE INJURIES AND DAMAGES COMPLAINED OF IN THIS PETITION.
PLAINTIFFS THROUGH PLAINTIFFS' COUNSEL HAVE ATTEMPTED TO REACH A REASONABLE SETTLEMENT AGREEMENT FOR THESES LOSSES WITH DEFENDANT'S INSURANCE CARRIER TO NO AVAIL; THEREFORE, THIS LAWSUIT WAS NECESSARY TO PRESERVE THE STATUTE OF LIMITATIONS AND HOLD DEFENDANT'S INSURER ACCOUNTABLE, UNDER ITS LIABILITY INSURANCE POLICEY, FOR PLAINTIFFS' LOSSES DUE TO THE SUBJECT CRASH.
DEFENDANT SAMANTHA LOONEY HAD A DUTY TO EXERCISE THE DEGREE OF CARE THAT A REASONABLY CAREFUL PERSON WOULD USE TO AVOID HARM TO OTHEERS UNDER CIRCUMSTANCES SIMILAR TO THOSE DSECRlBED HEREIN.
PLAINTIFFS' INJURIES WERE PROXIMATLEY CAUSES BY DEFENDANT'S NEGLIGENT, CARELESS AND RECKLESS DIREGARD OF SAID DUTY. THE NEGLIGENT, CARELESS AND RECKLESS DISREGARD OF DUTY OF DEFENDANT CONSISTED OF, BUT IS NOT LIMITED TO, THE FOLLOWING ACTS AND OMISSIONS;
A. FAILED TO TIMELY APPLY HER BRAKES TO A VOID A COLLISION;
B. FAILED TO MAINTAIN AN ASSURED SAFE FOLLOWING DISTANCE;
C. FAILED TO PAY ATTENTION TO THE TRAFFIC AND ROADWAY IN FRONT OF HER;
D. FAILED TO CONTROL HER SPEED
DEFENDANT MICHAEL MONROE WAS THE OWNER OF THE VEHICLE DRIVEN BY DEFENDANT, SAMANTHA LOONEY, AT THE TIME OF THE ACCIDENT MADE THE BASIS OF THE SUIT.
DEFENDANT, MICHAEL MONROE, ENTRUSTED THE AFOREMENTIONED VEHICLE TO SAMANTHA LOONEY, AN INCOMPETENT DRIVER, FOR THE PURPOSE OF OPERATING IT ON THE PUBLIC STREETS AND HIGHWAYS OF TEXAS, AND THEREAFTER DEFENDANT, SAMANTHA LOONEY, OPERATED IT WITH KNOWLEDGE, CONSENT, AND PERMISSION OF DEFENDANT, MICHAEL MONROE.
DEFENDANT MICHAEL MONROE, KNEW, OR THROUGH THE EXERCISE OF REASONABLE CARE SHOULD HAVE KNOWN. THAT DEFENDANT, SAMANTHA LOONEY, WAS AN INCOMPETENT DRIVER.
AS DESCRIBED HEREIN, DEFENDANT, SAMANTHA LOONEY, WAS NEGLIGENT ON THE OCCASION IN QUESTION AND DEFENDANT. SAMANTHA LOONEY'S. A NEGLIGENCE WS THE PROXIMATE CAUSE OF PLAINTIFFS' DAMAGES.
THE CONDUCT OF DEFENDANT MICHAEL MONROE, AS EVIDENCE BY THE NEGLIGENT ENTRlJSTMENT OF HIS VEHICLE TO DEFENDANT, SAMANTHA LOONEY, WAS CHARACTERIZED BY SUCH AN ENTIRE LACK OF CARE AS TO THE AMOUNT TO ACTUAL CONSCIOUS INDIFFERENCE TO TO THE RIGHTS, SAFETY, OR WELFARE OF OTHERS AND AS SUCH CONSTITUTED GROSS NEGLIGENCE.
