PLAINTIFF DRIVER, FRANK PILCHER, SLOWED DUE TO TRAFFIC, DEFENDANT KELLY CHANGED LANES WHEN IT WAS UNSAFE STRIKING PLAINTIFFS’ VEHICLE, RESULTING IN SERIOUS AND PERMANENT INJURIES TO PLAINTIFFS. ON OR ABOUT DECEMBER, 2014, AT APPROXIMATELY 5:20 PM.M, PLAINTIFF JUAN DE LEON (“PLAINTIFF”) WAS DRIVING HIS VEHICLE NORTHBOUND ON BRUTON ROAD NEAR THE INTERSECTION WITH YUCCA DRIVE IN THE CITY OF DALLAS, DALLAS COUNTY, TEXAS. DEFENDANT, OSCAR ALREDO LOPEZ (“DEFENDANT”), DRIVING HIS VEHICLE ON YUCCA DRIVE, DISREGARDED A STOP SIGN AND PROCEEDED INTO THE INTERSECTION WITH INSUFFICIENT CLEARANCE. PLAINTIFF WAS UNABLE TO STOP IN TIME AND DEFENDANT COLLIDED WITH THE FRONT DRIVER’S SIDE OF PLAINTIFF’S VEHICLE, CAUSING INJURY TO PLAINTIFF AND SEVERE DAMAGE TO BOTH VEHICLES.
DEFENDANT HAD A DUTY TO EXERCISE THE DEGREE OF CARE THAT A REASONABLY CAREFUL PERSON WOULD USE TO AVOID HARM TO OTHERS UNDER CIRCUMSTANCES SIMILAR TO THOSE DESCRIBED HEREIN.
PLAINTIFF’S INJURIES WERE PROXIMATELY CAUSED BY THE NEGLIGENT, CARELESS AND RECKLESS DISREGARD OF SAID DUTY BY DEFENDANT.
